The company BIOMÁNIA spol. s.r.o., the operator of DEUSdesigned and the website www.deusdesigned.com, processes personal data due to the necessity of fulfilling its contractual obligations in relation to the persons concerned (the contract with you) regarding the sale of goods (and/or to carry out necessary and necessary measures even before the conclusion of such a contract). , further processes personal data that are necessary for the fulfillment of other legal regulations by which the operator is bound (public law obligations) in accordance with applicable legislation.

  1. Legal basis for personal data processing

The legal basis for the processing of your personal data is the fact that this processing is necessary for:

  1. The conclusion of a contract between you (the affected person) and the operator or for the execution of the operator's measures before the conclusion of such a contract in accordance with Art. 6 par. 1 letter b) Regulations of the European Parliament and of the Council 2016/679 on the protection of natural persons in connection with the processing of personal data and on the free movement of such data and on the repeal of Directive 95/46/EC (general regulation on the protection of personal data) (hereinafter referred to as the "regulation") and § 13 par. 1 letter b) Act no. 18/2018 Coll. on the protection of personal data and on the amendment of certain laws (hereinafter referred to as the "Law").

  2. Fulfillment of legal obligations that apply to the operator, pursuant to Art. 6 par. 1 letter c) of the regulation and § 13 par. 1 letter c) of the Act, namely the fulfillment of the storage obligations of the operator according to a special legal regulation or contract, in particular:

    • Act No. 235/2004 Coll., on value added tax, as amended,

    • Act No. 586/1992 Coll. on income taxes, as amended a

    • Act No. 563/1991 Coll., on accounting, as amended.

  1. The purpose of personal data processing

The purpose of processing your personal data is the fulfillment of the contract between you as the person concerned and the operator, including the order of the goods, their delivery and the resolution of liability rights for errors or implementation of measures by the operator before the conclusion of such a contract, and further the fulfillment of related public law obligations of the operator.

On the part of the operator, there is no automatic individual decision-making, including profiling in accordance with the regulation of Art. 22 of the regulation and § 28 of the Act.

  1. Period of storage of personal data

Your personal data will be processed in accordance with applicable legislation for the duration of the effects of the rights and obligations arising from the contractual relationship. Furthermore, your data will be processed for the period necessary for the purposes of archiving, which is determined according to the relevant generally binding legal regulations, but at the longest for the period established by generally binding legal regulations.

  1. Scope of data processing

In accordance with legal regulations, the operator processes only the absolutely necessary data of the person concerned in order to offer you high-quality goods and customized services.

  • Telephone number

  • E-mail adress

In justified cases:

  • Purchase history

  • History of visited pages on the Internet

  • Activity history in e-mail campaigns

  1. Other recipients of personal data

Other recipients of your personal data may be / will be shipping companies and other persons involved in the delivery of goods (e.g. courier service, or recipients of payments based on a purchase contract, or persons providing technical services related to the e-shop for the operator, including software operation and data storage.

Recipients of your personal data processed for the purpose of fulfilling the obligations arising from the legal regulations by which the operator is bound can further be (authorized applicants) financial administration bodies or other relevant authorities (court, prosecutor's office, police force) in cases and to the extent imposed by generally binding legal regulations.

Transfer of personal data to a third country or international organization

The operator does not intend to transfer your personal data to a third country (outside the EU) or an international organization.

  1. Rights of data subjects (data subjects)

Under the conditions set out in the regulation and the law, you have the following rights:

  • Withdraw consent - in cases where we process your personal data based on your consent, you have the right to withdraw this consent at any time. You can withdraw your consent electronically, at the address of the person responsible, in writing, by sending a notice of withdrawal of consent or in person at the operator. Withdrawal of consent does not affect the legality of the processing of personal data that we processed about you on the basis of it.

  • Right of access - you have the right to be provided with a copy of the personal data we hold about you, as well as information about how we use your personal data. In most cases, your personal data will be provided to you in written document form, unless you request another way of providing them. If you have requested the provision of this information by electronic means, it will be provided to you electronically if it is technically possible.

  • Right to rectification - we take reasonable measures to ensure the accuracy, completeness and timeliness of the information we have about you. If you believe that the data we hold is inaccurate, incomplete or out of date, please do not hesitate to ask us to correct, update or supplement this information.

  • Right to deletion (to be forgotten) - you have the right to ask us to delete your personal data, for example, if the personal data we have obtained about you is no longer necessary to fulfill the original purpose of processing. However, your right must be assessed in light of all the relevant circumstances. For example, we may have certain legal and regulatory obligations which mean that we will not be able to comply with your request.

  • Right to restriction of processing - under certain circumstances, you are entitled to ask us to stop using your personal data. These are, for example, cases when you think that the personal data we have about you may be inaccurate or when you think that we no longer need to use your personal data.

  • The right to data portability - under certain circumstances, you have the right to ask us to transfer the personal data you have provided to us to another third party of your choice. However, the right to portability only applies to personal data that we have obtained from you on the basis of consent or on the basis of a contract to which you are a party.

  • Right to object - you have the right to object to data processing based on our legitimate legitimate interests. In the event that we do not have a compelling legitimate reason for processing and you file an objection, we will not process your personal data further.

  • The right to submit a proposal to initiate proceedings on the protection of personal data - if you believe that your personal data has been processed unfairly or illegally, you can file a complaint with the supervisory authority, which is the Personal Data Protection Office of the Slovak Republic, Hraničná 12, 820 07 Bratislava 27; tel. number: +421 /2/ 3231 3214; mail: statny.dozor@pdp.gov.sk , https://dataprotection.gov.sk . In the case of submission of the proposal in electronic form, it is necessary that it fulfills the requirements according to § 19 par. 1 of Act no. 71/1967 Coll. on administrative procedure (correct order).

  1. Profiling and automated processing

We do not use profiling or automated processing of your personal data on our pages or campaigns.
